Taiwan Indicts Nine for Illegal Export of AI Servers to China

Taiwanese prosecutors have concluded their investigation into the illegal export of high-end AI servers and have indicted nine individuals for their roles in the smuggling operation. This case, managed by the Keelung District Prosecutors’ Office, represents Taiwan’s first formal criminal action centered on AI server smuggling involving document forgery.

The investigation began in May 2026 with the arrest of three suspects accused of forging shipping documents to disguise the true destinations of Supermicro AI servers equipped with Nvidia chips, which are subject to strict U.S. export controls. Subsequent raids in late June and early July led to additional arrests, including employees from Supermicro and Nvidia. Supermicro confirmed that four of its Taiwan-based staff were questioned but stated that the company was not the target of the investigation and had fully cooperated with authorities.

Approximately 50 servers valued at over $15 million were seized during the investigation. This action builds on a related U.S. federal indictment from March 2026, where three individuals connected to Supermicro were charged with conspiring to divert approximately $2.5 billion worth of Nvidia-powered servers to China.

The focus on forgery as the criminal mechanism is notable, as Taiwan opted to emphasize the falsification of documents rather than proving intent to violate export laws. This legal action comes amid heightened tensions between Taiwan and China, with implications for the broader U.S.-China-Taiwan technology rivalry.
